Robert Jxxxxxx v. Kevin Cochran Trucking Company: This was a claim involving a driver of a dump truck who, unbeknownst to him, worked for an employer who did not maintain workers’ compensation insurance. Due to the fact that the employer had no insurance, the claim was tried to the Administrative Law Judge who found that the claimant sustained permanent partial disabilities and, more importantly, that the employer was required to pay for all medical care, past and future. Due to the fact that the employer was uninsured, the Second Injury Fund stepped into the shoes of the employer and made various unsubstantiated demands with regard to medical treatment that the Administrative Law Judge found unpersuasive and noted that the Second Injury Fund stepped into the shoes of the employer and, therefore, conferred no additional defenses nor rights to the Second Injury Fund.
