Phillip Dxxxxxx v. Teddy Williams: This was a premises/personal negligence claim by the plaintiff against his “then” employer for an injury that arose out of an employment related party at the employer’s residence where the employer furnished food and alcoholic beverage as well as boat rides on a lake with the employer’s boat. The employer was operating the boat on a small lake after having allegedly consumed alcohol and instructing the plaintiff to engage in “tubing” behind the boat. The employer allegedly recklessly operated the boat by travelling very fast and operating the boat in such a way as to create a sling shot effect when operating close to the shore. As a result of the speed and the maneuvering of the boat by the employer, the plaintiff was catapulted from the tube into the shallow portion of the lake causing a massive internal injury requiring substantial care and treatment. Settlement for a substantial amount was achieved in favor of plaintiff.
