SLIP AND FALL WORKERS’ COMPENSATION CASE

Starlyn Wxxxxxx v. Mid America Mobile Systems:

This case involved a claimant who slipped and fell on ice in the parking lot of her employer and sustained two faulting disks in her back. The employer offered a nominal amount for settlement which was rejected by the claimant and the claimant’s attorney, even though the claimant’s attorney, at that time, was recommending settlement. The claimant then hired me to represent her against the employer. The claim was tried in St. Charles County where the Judge found that the claimant was permanently partially disabled and that she was able to return to work. Both the claimant and the employer filed an appeal to the Labor and Industrial Relations Commission who overturned the underlying Administrative Law Judge’s award and awarded permanent total disability against the employer in favor of the claimant.
